Terms of Service

1. Acceptance of Terms

By accessing or using OrbitalMCP ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

OrbitalMCP provides a hosted API service for storing, indexing, and retrieving text content using vector embeddings. The Service includes REST API access and Model Context Protocol (MCP) integration for AI agents.

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and API keys
• Promptly notify us of any unauthorized access
• Be at least 18 years old or have legal authority to enter into this agreement

4. Acceptable Use

You agree not to use the Service to:

• Store or transmit illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use the Service to send spam or unsolicited communications
• Store personally identifiable information without proper consent

5. Your Content

You retain all rights to the content you submit to the Service. By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Create vector embeddings of your content for search functionality
• Make backups for disaster recovery purposes

6. Service Plans and Payment

The Service is offered under various plans with different usage limits:

• Starter: Free tier with limited documents and queries
• Pro: Paid tier with higher limits and additional features
• Enterprise: Custom plans with dedicated support

Paid subscriptions are billed monthly or annually. You may cancel at any time, and your subscription will remain active until the end of the billing period.

7. API Usage

Your use of the API is subject to rate limits based on your plan. You agree to:

• Keep your API keys confidential
• Not exceed your plan's usage limits
• Not attempt to circumvent rate limiting or security measures
• Use the API in accordance with our documentation

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice for planned maintenance when possible.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBITALMCP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify and hold harmless OrbitalMCP and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a 30-day grace period.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
